Mrs. Vesta Ames, whose home is in Butler, has brought suit in the circuit court at Auburn, through her attorney, E. B. Dunten, for a divorce from Charles A. Ames, asking also for alimony and the custody of their two children.

"The complaint alleges that they were married on July 14, 1904 and lived together until March 14, 1908. when Plaintiff was compelled to leave him on account of his drunken habits, cruelty, neglect and failure to provide.

"They formerly resided at Butler but moved to Goshen in July of 1907, and there he began his drinking habits and then became a bartender in a saloon It was after that his drinking habits, abuse, etc., toward his wife and family began. She alleges that he is a habitual drunkard.

Interesting that in Deed Book 77 page 63 there is a Deed where Clara Etta Brunkhart, unmarried conveys and warrant to Harry L Jenkins and Flossie V. Jenkins Lot 118 in the original plat of the City of Auburn. This is Dated Jan. 5, 1909.

"Luella Camp, who is a teacher in the schools at Angola, has begun suit in the circuit court here, through her attorneys, Powers and Yeagley, of Angola for a divorce from her husband, Frank W Camp, an employee of the Lake Shore Railroad Company at Waterloo. She also asks alimony in the sum of $1,000.

"In the complaint it is alleged that the parties were married on September 26, 1905, and that immediately thereafter they went to the home of defendants mother to live. The complaint says that the actions of the mother were such that she could not reside there. Then complainant took apartments of her own elsewhere, but, except to occasionally visit her, the defendant remained at the home of his mother.

"She says that he became so that he did not provide for her wants and was cruel and neglectful so much so that he was completed to resume her former occupation of a teacher, and she took apposition as such in the schools at Angola."

Jonathan P. Collett is a practicing dentist at St. Mary's Ohio The Plaintiff and Defendant were married June 14, 1899. and lived together until December 29, 1906. when. Mrs. Margaret Collett and Edith aged 7 and George aged 5 left and moved to Auburn where they are living with her father Thomas C. Ford A divorce was granted in the courts of County of Augiaize, Ohio on January 13, 1908. and Jonathan was given custody of George. In the newspaper there is a lot of detail. Trial was set for March 8 Page 513. Most of document destroyed.

In this issue of the paper there is a large news item on page one with the heading: "DIVORCED HUSBAND AND WIFE FIGHTING FOR CUSTODY OF CHILDREN" Given in three chapters.

"Because of the prominence of the parties and the fact that they are so well known in Auburn, coupled with the interesting features in the lives of two of them, the husband and wife, the case of Jonathan P. Collett vs. Margaret Collett and Thomas C. Ford, which is set down for hearing in the circuit court here before Judge Bratton on the 8th of March next, will be one that will attract wide attention and interest.

"The action is one known in law as habeas corpus proceedings -or an action to recover the possession of person." Note as stated the dialogue covers most of the first page of the paper.

Divorce, Alimony and Custody of Children. Page 341, 342 Divorce is granted; but sad to say the details are not available because of the 1913 fire.

In the circuit court at Auburn on Monday evening Clara Deal of Garrett, was given a divorce from her husband, George Deal, who is a trainman on the B. & O. railroad with a run out of this city.

The complaint was filed Monday afternoon about 4 o'clock by D. D. Moody, the attorney for the plaintiff. It charged cruelty and adultery, the name of the woman being given. The hearing came up by agreement, W. W. Sharpless entering the appearance of the defendant.

The testimony was taken and Judge Bratton granted the divorce before the shades of night had gathered over the earth. The plaintiff was given the custody of the two children, who were allowed $15 a month for their support. Mrs. Deal was given $50 alimony and Attorney Moody was allowed ? Attorney fees.

"Readers will remember that not long since a mother with three children, was stranded in Kendallville and that the little girl was left with a Kendallville family, while boys were put in a mission at Fort Wayne. Now the father, Robert Fogt, comes on the scene, arriving Friday evening from a Michigan town, where he had just finished a term in jail. He found that his wife was at Garrett and he went there and found her. He gave her some money to buy clothing and then went in search of his children. Two of them ad pleasant homes, and he left them there. On his return he found that his wife had skipped out. He then left for VanWert, O., with his little girl.

Dunten of Butler, as attorney for the plaintiff, Mrs. Grace Edyvean, has begun a somewhat sensational divorce suit in the circuit court, the complaint having been filed Monday, The defendant in the case is William Edyvean, and formerly he was a supply pastor at the Methodist church in Butler. It was at that time he became acquainted with and married the plaintiff. This marriage took place on November 25, 1905, and they lived together until February 16,1908.

"The grounds upon which the divorce is asked is adultery. The plaintiff, Mrs. Elyvean, who was formerly Grace Whitman, in her complaint charges that this adultery was committed on February 2, 1908, with one Blanche Anderson, and then the complaint continues. 'The tow having been caught in the commission of the act by the plaintiff. Immediately thereafter the plaintiff left the defendant and since then she has never seen or heard of him.'

"The plaintiff alleges that defendant did not contribute to her support. One child was born to them and the plaintiff asks that she be given the custody of this child.

"The defendant, Wm. Edyvean, came to Butler from Fort Wayne. He went there to temporarily supply the pastorate in the Methodist church. When he left Butler he went to Michigan, it being said, with the woman whose guilty act was the cause of the divorce suit being brought."

"The two were married on December 10, 1898 and lived together until November 7, 1907, when he drove her from home and told her never to return, threading that if she did so he would take and ax and smash her brains out. She took the child a girl, Effie, 7 years of age, and never returned to her husband's roof.

"In her complaint Mrs. Frick alleges that her husband is an habitual drunkard and that he is cruel and inhuman to her. She says that he took $200 of her money and has never returned it to her; that he also sold live stock belonging to her a colt, hogs, two cows for $150, and has used the money for his own personal wants.

"She alleges that defendant has real estate value at $1,000 and personal property valued at $00. She asks for alimony in the sum of $300 and that he pay back to her $20 0 borrowed and $140 for personal property sold also the custody of the daughter and maintenance of 150 a year.:

"To be a divorcee and a married woman again within an hour was the unusual matrimonial experience of Mrs. Alice Geisinger of this city. On Monday afternoon at 1 o'clock Judge Bratton handed Mrs. Geisinger a decision of divorce from her husband, Joseph Geisinger on the grounds of desertion and while Deputy Clerk Atkinson was making out the divorce decree County Clerk Jenkins filled out a marriage license. A few minutes after and Justice A. P. Green had tied the nuptial knot for Mire. Geisinger and David Pierson. Mr. and Mrs. Pierson will make their home on the groom's farm in Wilmington Township. He is sixty-four and she is fifty-two. Another article appears in the January 23rd addition (explaining the marriage to David Pierson).

Divorce Notice to defendant published. Page 348 Notice to Defendant in the DeKalb County Herald. Defendant in default. Page 349 is mostly burned; but it appears that divorce was granted and Plaintiff to resume her maiden name.

Paper States: Alleging that he is an habitual drunkard and that there is no probability of his reformation and further alleging that he has abused and abandoned her. Grace Green asks for a divorce from Homer Green.

"The complaint was filed in the circuit court Thursday by E. B. Dunten, of Butler as attorney for the plaintiff.

:It is alleged in this complaint that he parties were married on November 29, 1907, and that they only lived together for about three weeks when he left her and since then has not contributed to her support.

"She says that she became engaged to him four years before the marriage she did not know that he was an habitual drunkard, although in those years they were in constant correspondence with each other.

"Two days after their marriage, she says in her complaint, he became intoxicated and continued to be in that condition almost constantly afterwards. December 25, 1907 she remonstrated with him because of his habits and he took exceptions to it and cursed and abused her. Thereupon he left her and she has not since heard directly from him.

"The plaintiff says in concluding her complaints that there is no probability of his reformation. Hence she asks for a divorce and restoration of her maiden name Grace Poper. There are no children as a result of this marriage.

Nearly five years ago, Miss Grace Poper of Butler, became engaged to Homer Green. For four years they corresponded but did not see each other until the wedding day. November 29, 1907. The first day was a delightful honeymoon, happiness reigned supreme, the groom had the appearance of being a "darling dear" but the second day he took on a load of booze that changed the honeymoon into one of disappointment happiness was changed into sorrow and he became a demon. For three weeks they lived as man and wife, she hoping that she could reform him, but to no avail and on Christmas following he left her cursing for her chastisement.

Such are the statements in the complaint filed for a divorce by Mrs. Green late yesterday afternoon. She wants to be divorced from the one who misrepresented himself to her and kept his distance until the wedding day, all of which time she says she learned later that he was an habitual drunkard. She says he has left the state and his whereabouts is unknown.

"She alleges that Grimes is in the habit of getting intoxicated and comes to the home and destroys the household goods and does damage to the property. She says that because of his drunkenness and cruelty to her it has become impossible for her to live with him, and they are now living separate

"Since their separation she has demanded of him that he shall not visit her, but that he continues to do so, and with his visits does damage to the property and threatens bodily injury to her.

"She fears him and fears further damage to the property. Hence, the suit for restraining orders.

"Mounts & Brinkerhoff are the attorneys for the plaintiff. Sharpless and Atkinson have been employed by the defendant to look after his interests.

"Judge Bratton has issued the temporary restraining order."

The parties reside at Butler. in her complaint she state that they were married in 1903 and they lived together until April 1, 1908, when she left him. She says he is an habitual drunkard and has been cruel and inhuman to her and has neglected to provide for the household.

On April first he abused her and told her he had ceased to love her. He told her he wanted her to leave him, saying; 'the quicker she got away the better.' Fearing bodily harm, she then left him. The parties have no children."

Paper states: In the circuit court on Tuesday, Mary J. Hamilton was given a divorce from Wm. M. Hamilton. The plaintiff formerly resided at Garrett, but for some time past has been employed in Auburn. On the witness stand she testified that she was married in January of 1900 to the defendant, who during the time they lived in Garrett, was employed as a brakeman on the B. & O. railroad. He was addicted to liquor and also gambling, and she testified that he spent most of his money in this way, failing to provide a living and leaving the rent for their house unpaid. On this account they were compelled to move from one house to another. She stated that he left Garrett with many debts unpaid and that he was now some place in Oklahoma.

"Something like a year ago in the circuit court here Attorney D. D. Moody secured fro Mrs. J. C. Hayes of Garrett a divorce from her husband. In the decree of divorce Mrs. Hayes was given alimony for $200. and an allowance of $10. a month for the support of their child, the custody of which was given to the wife.

"Hayes was an employee of the B. & O. railroad at Garrett. He promised to pay the allowance of the child promptly each month, but neglected to do so and as a consequence he was brought before Judge Bratton by the deputy sheriff to answer for his neglect in this regard. He made the showing that he had been ill for quite a while, and on his renewed promise to pay the $10 a month allowance, he was released.

:This promise he failed to keep. He never paid a dollar of the alimony or a dollar for the allowance of the child, all the provisions for the support of the latter and herself being paid by divorced wife. Thus things went on for a while. Then the attorney and Mrs. Hayes had an order issued for the arrest of Hayes and his brining into court. When the deputy sheriff went to get Hayes he could not be found. He left Garrett and the officer could not learn his exact whereabouts

"On Wednesday Deputy Sheriff Jay D. Raub was in Garrett serving court papers and learning that Hayes was there he took him into custody and brought him to Auburn and placed him in jail to await a hearing before Judge Bratton in the circuit Court."

When Mrs. Hayes was given a divorce a year or so ago she was allowed $200 besides $10 a month for the support of a child. It is alleged that Hayes has not paid a cent of his alimony or the monthly allowance even after his repeated promises ad threats of his wife. Then Mrs. Hayes had an order issued for the arrest of her ex husband and he is in he county jail pending a hearing>"

After this marriage everything seemed lovely for a while and then it was that the complaint charges Mrs. Luttmans with having abused his two children by his first wife, whom she promised to be a mother to, as though they were her own, etc The complaint alleges that she abused them and threatened to kill them and cut their hearts out and show them how they looked, etc. Then the wife left the home and has not since returned.

"Amos Luttman is again asking for a divorce from his wife Maria Luttman. He asked for a divorce from her once before. That was about two years ago. Then a divorce complaint was filed in court, but afterwards the parties patched up affairs and the divorce proceedings were dismissed. No Mr. Luttman has resumed his efforts to secure a divorce. In the circuit court here, through his attorney, J. E. Pomperoy, he has filed his complaint.

"In the complaint it is recited that the parties were married on Christmas day of 1907. They lived together as man and wife until Lincoln's birthday of the following year, February 12, 1908, when he says she abandoned him and left his household. He says she was cruel and inhuman in her treatment of his children by a former marriage. Three of them, the youngest five years of age. She had promised, so he says, to be kind to them, but he says, she was not. Hence their troubles and hence the divorce proceedings.

Alexander Platter is hereby restrained from selling mortgages or otherwise disposing of his horse, cattle, horse wagon, farming utensil, grain or other farm products or household goods. And also restrained from selling mortgaging conveying or in any manner encumbering any of his Real Estate during this action. Case 8186 is now dismissed .

"D.D. Moody, as attorney for his client. Estella A. Platter, has begun suit in the circuit court, asking that she be given a divorce from her husband, Alexander Platter, alleging cruelty and other causes. The parties were married in 1890 and lived together as husband and wife until the present month. They have a daughter Myrtle aged 16, and Mrs. Platter asks that she be given her custody. She says that Platter has real and personal property to the amount of $6000 and she asks alimony in the sum of $1500 and that the daughter be allowed $100 a year for her support."

 

Paper States Sheriff J. W. Reed was called Sunday forenoon to the home of Alexander Platter, six miles east of Auburn, to take into custody Mr. Platter, who had become violent and was threatening to take his own life and also threatening others, he result of an insane streak coming from property and other difficulties. The sheriff brought him to the city and placed him in the county jail where Dr. u. G. Souder attended him

"Mr. Platter is the owner of the farm on which he resides, and it seems is in debt $1500. Some time ago his wife began divorce proceedings against him, but later they patched up their troubles and lived together. His troubles of mind however grew on him and his wife was in constant fear that he would do her bodily harm and also harm himself. At the time the sheriff took him into custody he was in bed at his home and he then had two axes in bed with him': Besides threatening others he also threatened his horses and chased them around the yard and field with axes. His actions became so violent that the sheriff was telephoned for. In jail he quieted down considerably and Monday forenoon he was lying on a cot in his cell exhausted. He had recovered his mind and talked quite rationally. He said he had eaten nothing, Since Saturday morning.

He will be kept in jail until he recovers from his unbalanced mental condition or the court determines what is best to do with him.

Paper states: In the circuit court on Friday forenoon Judge Bratton granted Frances Stafford a divorce from Emanuel Stafford. The charge was habitual drunkenness for a number of years. The parties have been married nearly a quarter of a century and have grown up children. Mrs. Stafford was allowed $600 alimony, which the defendant paid, the custody of the children. The defendant is a well-known farmer of the county.

Papers States In the circuit court at Auburn, through her attorneys Mountz and Brinkerhoff, Mrs. Catherine Sweeney, of this city has brought suit against her husband Michael Sweeny for divorce, alleging cruelty and failure to make proper provision for her support and that of her daughter.

Mr. Sweeney is the yardmaster of the B. & O. at Garrett and is one of the best-known railroad men here. The complaint states that he is earning $135 a month and has real estate valued at $3000. The wife says she paid $400 of her own money on this real estate. She asks for alimony in the sum of $300 and the custody of the child.

Papers states: "The Sweeney divorce case, the parties being from Garrett, and both very well known was called up in the circuit court on Thursday afternoon and, on motion of the attorneys of the defendant, M. H. Sweeney, was postponed until one day next week. The reason was that Mr. Sweeney was called to Tiffin, O., by the illness of his mother. The court granted the plaintiff an allowance of $40"

A step mother over at Butler has been the means of raising a rough house and led to the filing of complaint for divorce according to the allegations the husband filed Tuesday.

William. Topper says his wife, Mary by name, of only abut a year is cruel to his children by a former wife. He says she beats, compels them to sit for hours on a chair without privilege to get up and play, curses them and on December 26 stuffed biscuit dough into the youngest child's mouth choking it and when the father intervened the mother flew at him beat him and drove him from the house. He says no reconciliation is possible so long as he keeps the children and that he cannot give them up.

Divorce and custody of children. Case 8319 Defendant has been notified via Sheriffs summons. Defendant in default. Divorce granted and custody of Glenola Aged 11 yrs, Lovina Age 9 years, Elwin aged 10 months given to the Plaintiff.

Paper states: Mattie G. Vaugn, by her attorney, Geo. W. Crooks of Waterloo, has brought an action in the circuit court in Auburn for a divorce from her husband, Clarence Vaugn alleging cruelty, neglect etc. They were Married February 1, 1884, and lived together until Jun 21, 1908. when they separated, the wife alleging that he drove her from home.

"Among acts of cruelty alleged are that he struck and kicked her and called her vile names. He ordered her out of the house and told her that he never wanted to see her again. She had in her possession $10 in money. This he wanted her to give him and threatened to choke her if she did not tell him where it was. Under fear, she told him where the money was and he secured it. She alleges that he failed to provide for the support of the family. They have five children, ranging in age from one to fourteen years. She asks for their custody.

In DeKalb County Marriages there is a marriage for a Clarence Vaughn age 25 born in Williams County, Ohio to George w. & Elmira (Parson) Vaughn. He married Martha G. Hughs (age 20) born in Waterloo. Her parents were J.W. & ? (Booth) Hughs. They were married February 11, 1894 in Waterloo, IN.

Complaint for Support. Parts of document destroyed. What can be made out is that Lewis J. Wightman files motion to strike certain parts and the defendant was to file a bill of exceptions. The Hamilton National Bank was also a defendant. A decision had been made by the Allen Superior Court and Lewis J. Wightman is to pay for support and maintenance for the months of June and July. Paper States: A case of considerable interest disposed of was that of Frances M. Wightman vs. Lewis Wightman. It came here by change of venue form Fort Wayne, where the parties are well known. The defendant is the manager of a large business establishment in that city. The wife sued for support. Judge Bratton allowed her $60 for present necessities and decreed that defendant pay her $25. a month

An answer to a complaint for divorce brought by Mrs. M. Wightman of Ft. Wayne in which she also asks for a temporary allowance from her husband, Lewis M. Wightman, was filed in the DeKalb circuit court last Friday. This suit was begun in Allen County and brought to DeKalb county on change of venue. In her petition for an allowance for her own support of $50 per month and $200 to prosecute the case in court, she says her husband refused to properly provide for her, that it was necessary for her to go to his place of business and in the presence of his clerks, beg of money and that he has left her without manes, etc.

His answer is rater a sensational one which charges his wife with being a habitual drunkard and has been since they were married in 1901. He says she has spent his money ravishly often getting dead drunk, one time being locked up in the Marion County jail over night and in the morning fined one dollar and costs. Other similar answers follow which hold up the wife in a bad colored light. Copied form the Auburn Dispatch.

Papers states

"Mountz & Brinkerhoff s attorneys for Bertha Wilhelm, of Garrett, have filed in the circuit curt a complaint asking that their cline be given a divorce from her husband, Charles Wilhelm, the custody of their one child, Claremont, a year old, and $500 alimony.

The parties to the suit, Mr. and Mrs. Wilhelm only lived tighter as man wife for one day. They were married on November 6, 1906 and the next day November 7, 1906, the husband deserted her and has not since provided for her, nor does she know his whereabouts, as he has not communicated with her since.

The defendant, Wilhelm, was a trainman on the B. & O. road and at the time of the marriage, lived in Garrett.

These facts are set forth in the complaint and as grounds for the divorce she alleges cruel and inhuman treatment and abandonment.
