Suit has been filed in circuit court to set aside the last will of John M. Murdock, Fountain County farmer, who died in August, leaving an estate valued at $26,000 (smudged might be $29,000) in personal property and real estate. The plaintiff is Mary E. Forrest, daughter of the decedent and the other heirs and beneficiaries of the existing will are made defendants. The plaintiff alleges that the will was dated June 7, 1923, probated Aug 24, 1927. Lydia F. Murdock, widow of the deceased, was named executor. By the terms of the will, after the death of the widow one-half of the estate was given to the son, William L. Murdock __ fee, and the plaintiffs interest in the other one-half was limited to a life estate, it being provided __ her death the same was to ___ to the children of William Murdock. The plaintiff alleges that the testator was of failing mind at the time the will was executed and asks that it be declared null and void.
