Will of Charles Tucker of Essex County, New Jersey

In the name of God Amen--I Charles Tooker of Elizabeth Town in the County of Essex within the provience of East new Jersey, Yoeman Being through Divine Goodness of sound and perfect mind and memory do make and ordain This my Last Will and Testament in manner and form following That is to say First I commit my soul and spirit unto almighty God that gave it and my Body to the dust whence it was Taken to receive a Decent Christian like Burial and as for that temporal and worldly goods which it hath pleased almighty God to bestow upon me I give grant devise bequeath and dispose of the same in manner and form following First I will and ordain that all my funeral Charges and all just Debts as I shall Justly owe at the time of my decease shall be well and truly paid out of my moveable Estate by my Executors herein after named Item I Give and bequeath unto my Eldest son Charles jur and to his heirs and assigns forever the one half part of Equal moiety (money??) of all my Rights of Commonage of lands and meadows yet to be taken up in the bounds of Elizabeth town aforesaid Item I Give grant Devise and bequeath Unto my youngest son John Tooker and to his heirs and assigns for Ever all that farm or Plantation Containing by Estimation one hundred acres of land be the same more or less lying on the southwest side of the Road leading to the grist mill of Samuel Oliver late of Elizabeth town Deceased which sd plantation of lands I purchased of several persons at several times and by several parcels as by their several Deeds of Conveyance to me for the same may appear And also I give and bequeath unto my sd son John Tooker and to his heirs and assigns forever All my meadow ground to me belonging or appertaining within the bounds of Elizabeth Town aforesaid Also I give and grant and bequeath unto my sd son John Tooker and to his heirs and assigns forever all the one half or Equal moiety of all my Rights of Commonage in lands and meadows in the bounds of Elizabeth Town aforesaid Item I give and bequeath Unto my grandson Warner Tucker one heifer of two years old to be delivered to him when he comes to the age of twenty three years and one heifer of one year to be delivered at my Decease Item after my funeral Expenses my just Debts and above bequeathed legacy or legacyes paid I give and bequeath unto my sd son John Tooker all the remaining part of all my moveable or personal Estate (if any remain) by him the sd son John Tucker and his heirs to be possessed and Enjoyed Item I do make ordain and apoint my beloved brother Joseph Tooker and my Trusty friend John Spinning and the sd John Tooker my son to be joint executors of this (several words illegible from worn fold of the paper) and I do hereby Revoke and make void all other Testaments by me hereto fore made or Declared Ratifying and Confirming This to be my Last Will and Testament In Witness whereof I have hereunto put my mark Instead of my Name and affixes my seal This twenty first Day of april in the Eighth year of the Reign of our soverign Lord George the second by the grace of God of great Britain King etc ANNO DOMINI one Thousand seven hundred and Thirty five Sealed published and declared by the sd Charles Tooker Testator to be his Last Will and Charles Tucker (his mark X)

Be it Rem: that on this present Sixth day of May One thousand seven hundred and forty James Wood and John Terrill two of the witnesses to the within Will personally came before me Thomas Bartow duly deposes and appointed to prove wills, etc and being duly sworn on the holy evangelsts of Almighty God Deposed that they were present and saw Charles Tooker the Testator within named Sign and seal the within written Instrument and heard him publish pronounce and declare the same to be his last Will and Testament and that at the doing thereof the said testator was of sound mind and memory to the best of their knowledge and as they believed and at the same time Robert Morss (or Marsh) the other witness was present and signed his name as also did they the Deponents in the Testator's presence.
