Will of Caleb JessupBk. 1 pg. 12-8, no pg. 19, 20 Filed Oct. 4, 1843 I Caleb Jessup of the County of Greene and the State of Indiana do make and publish his my last will and testament hereby revoking and making void all former wills by me at anythime heretofore made. And as such wordly estate as it has pleased God to entrust me with I depsoe of the same in the following manner towit: I direct first that all my just debts be paid as soon after my decease as possible out of the first moneys that shall come into the hands of my executors from any portion of my estate real or personal. I also direct that a fair evaluation or appraisement be made by three hudicous neighbors of all my said estate including my household furniture and after being signed with their names that a copy of the same be given by them to each of my executors. I hereby bequeath to my son James the tract of land on which he resides containing one hundred and seventy seven acres and twenty three hundreths as surveyed by John B. Kelshaw. And I hereby bequeath to my son Verlin the tract of land I purchased out of Sec. 15 containing eighty-five acres (more or less) and lying on the east side of the Eel RIver the said tract of land is to be paid for out of any money coming into the hands of the executors of my estate I also give to my son Verlin foruty acres out of the eighty acre lot I own in town 8 North of Range 5 West Section 9 to be equally divided by my executors. And I hereby bequeath to my three sons Philander, Elijah and Lafayette my home place on which I reside and the forty acres in Section 9 Town 8 No of Range 5 West to be equally divided between them according to its true value. And I bequeath to my som Franklin the tract of land laying on the west side of Eel River bought out of No. _ known as the Tarwater place. I further will that the proceeds of the sale of all my personal effects after paying any debts be equally divided among all my children and that my beloved wife have a suff_ _ey out of the _ _ for her maintaince during her lifetime or widowhood. And I do hereby make my worthy firends Homar Clarke and Harbart Sanders executors of this my last will and testament. In testimony wereof I Caleb Jessep the testaor have hereunto set my hand and seal this twenty fifth day of Sept in the year of our Lord eighteen hundred and forty-two. Signed sealed published and declared by the above named Caleb Jessup as his last will and testament in the presence of us who have hereunto subscribed our names as witnesses therto in the presence of the said testaotor and in the presence of each other.Caleb (his X mark) Jessup (seal) Giles Williams Now I do hereby declare this present writing to be a codicio to the said will and direct the same to be annexed thereto and taken as a part thereof. And I hereby give bequeath to my son Verlin a certain lot of land bounded as follows - beginning in the North and South line of Sixteen at the Southwest corner of John Sander's land running eastwardly on the lin dividing Jessup and Sanders three rods past Verlin Jessup's house thence south to the spring branch thence with the meanderings of said branch to the line of sixteen thence north with the said line to the place of beginning containing fifteen acres more or less. In witness whereof I the said Caleb Jessup have to this codicil set my hand and sel this twenty fifth day of September eighteen hundred and forty-two. Spencer personally came before me Samuel R. Cavins clerk of the Probate Court of said county and after being by me duly sworn according to law desposes and says 'he was Caleb Jessup sign and publish and declare the within writings to be his last will and testament and codicil and that he believes he was at the time of its execution of sound mind and memory and that he signed his name thereto as a subscribing witness in the presence of the said testator and the other subscribing witnesses and at his request and came also James Mc Claren on the the said 4th day of October 1843 after being by me duly sowrn accrodin to law desposes and says that he saw Caleb Jesseup sign, seal publish and declare the wirtten codicil for the purposes therin _ed and that he believes that he was at the time of its execution of sound mind and memory and that he signed his name thereto as a subscribing witness in the presence of the testator and of the said Joohn B. Be it remembered that on the 6th day of October 1843 Giles Williams personally came before me Samuel R. Cavins, clerk of the Probate COurt of said county and after being nby me duly sworn according to law desposes and says that he saw Caleb Jessup sign seal publish and declare the within writing to be his last will and testament and that he believes he was at the time of its execution of sound mind and memory and that he signed his name there to as a subscribing witness in the presence of the said testator and the other subscribing witness and at his request.
