Will of Enoch MorrisBk. 1 page 27-28 Enoch Morris's will examintation proofs filed December 12th, 1844. This _ May in the year of our Lord 1839. State of Indiana, Greene county. In the Name of God amen. I Enoch Morris of the county and state aforesaid. Being in helth [health] of body and of a sound mind and memory and knowing also that it is appointed for all men once to die and that in the course of human events from my advance age that I cannot reasonable expect to survive manyyears say probably my days may even be very few and being also _ous to the end that my _ory and worldly affairs be amicably and justly settled that there by I may save to my heirs and posterity p_e and g_tude int the sttlement there of and much expense and _ an unnecessary li_gation to the end therefore that there _ be _ed by my posterity as aforesaid. Be it known by those presence that I do make and establish this my last wil and testament and depose of my real and personal estate as herein after mentioned towit. First of all I give and bequeath to my beloved wife Phebe Morris the eighty acres of land on whihc I now live it being the East half of the Southeast quarter of section No. seventeen in township six North of Range Seven West for her to enjoy all the profits of the land during her widowhood and then to be my youngest sons Hiram Morris. Naxt I give and bequeath to my son Isaih [Isaiah] Morris the South half of the SOuthwest quarter of Section _teen it being part of the _ section of towne One Range Seven this last named lot of and is not yet paid out for should I not do it in my lifetime. It is to be paid for out of my personal estate. As to my personal estate first of all I will that all my just debts be paid and then the balance of my said personal property is to be my beloved wife's Phebe Morris during her widowhood and then to be divided as follows to be equally divided amongest my children that I had by my last wife which I will here in name towit: Rhody Whitconack, Mana Wintconack, Isaih [Isaiah] Morris, Rachel Morris, Charlotte Morris, Elander Morris, Mahala Morris, Lucinda Morris and Hiram Morris. And unto my children that I had by my first wife towit: Sary Hartley, William Morris, Abigail Asher, Robert Morris, Byer Shoomatter, Jacob Morris and Pheby Smith to these last named children that I had by my first wife I do not leave anything as the property that I now possess I have made since they left me. And lastly I do hereby nominate, ordain and appoint Isaih [Isaiah] Morris of the county aforesaid my true and lawful executor of this my last will and testament hereby dellegating [delegating] him with all the legal honor necessary to carry into effect my intentions and bequeaths as herein stated and hereby revoking and annuling and canceling any and all former wills, codicils by me made and sibscribed and _ hereby in the event that I have omitted the desposing of any part or portion of my property be the same either real or personal I do hereby vest my said executor with full and ample power to divide the same amongest my first named children by my last wife in equal portions according to the rate of apportionment here in by me named to said heirs and _gal_ respectively. Signes sealed & declared in the presence of the undersigned and in the presences of the testaor and of each other.Enoch (his mark) Morris I Samuel R Cavins clerk of said Court do hereby certify that the within last will and testament of Enoch Morris was brought before said court and was duly proved by the oath of John Hall one of the witnesses thereto whose examination was reduced to writing and subscribed to as follows to wit:John Hall I JOhn Hall do solomenly swear that on the _th day of May 1839 I saw Enoch Morris, sign seal publish and declare the within and foregoing writing puproting to be his last will and tesament that I signed my name thereto as a subscribing witness in the presence of the said Enoch Morris and at his request that the said Enoch Morris was of full age to devise his property and of sound mind and memory at the time of his _ and _ his _ or restraint and that of his own free will and accord he signed said will that I am of lawfull ageand in no wise interested in either real or personal estate of said deceased. In testimony where of I have hereunto set my hand and the adopted seal of said court at Bloomfield on this 12th day of December 1844John Hall S. R. Cavins, Clk. |
