Will of John O'Neall

State of Indiana Greene County}

I John O'Neall of the state and county aforesaid neing weak of body but of sound desposing mind and memory have thought proper to make and declare this to be my last will and testament.

As I have given each of my children part of my estate, therefor what I am now _est with I give and despose of in the following manner and form.

1st My desire is that my just debts (if any) be speeedily and promptly paid

2nd My desire is that my land sall be divided btewwen my two sons Cary and Hiram in such manner and form as that Hiram shall be worth one hundred dollars more than Carys so that each ones part shall be joing the land they now _ said division to be done by Peter R> Lester and Lewiss Champ_ and if they cannot agree _ _ division they may nominate some other d_ person to _ in said division

3rd It is my will and desire that Cary shall make or to be _ and deed or deeds to Hiram witht he exception of two which shall be made to Thomas W. Hugh as was agreed nbetween him and myself if the Town of Newberry is _ liad off.

4th I give and bequeath to my son Hiram my books and rifle gun.

5th I give and bequeath to Nathan _ a _ horse coalled Bold _ one saddle.

6th. It is my desire that my beloved wife Hephzibah shall have the balance of my personal propoerty during her natural life and at her decease to be equally divided between my daughters property to the amount of fifty dollars be _ which I desire my son Mark shall have at his mothers _.

7th. ANd lastly I consitute nominate and appoint Cary O'Neall and Hirma _ executors of this my last will and testament with a special desire that they attend to the _ of their aged mother and I hereby evoke and _ former wills by me made and acknowledge and confirm this to _ last will and testament.

The Presence of each other have here unto subscribed the _ with _ in the year of our Lord one thousand eight hundred and thirty eight _.

Be it remembered that _ day of January in the year of our Lord one thousand eight hundred and forty-one that Lewis Chapman personally appeared before me Samuel R. Cavins clerk of the probate court in and for said county and after being by me duly sworn according to law deposes and says I saw John O'Neall sign seal publish and declare the within writing to be his last will and testament and that he was at the time of its execution of sound mind and memory and that I signed my name therto as a subscribing witness in the presence of said testator and at his request So help me God.
