Will of Daniel H. Fields



Bk. 4 pg. 543

I, Daniel H. Fields being of my right mind do make this my last will and testament.

1. I will and bequeath to my beloved son Elmer C. Fields the Northeast quarter of the Southwest quarter of Section thirty-six (36) Township seven North of Range seven West, containing forty (40) acres, on the following conditions, to-wit: That my beloved wife Nancy Fields is tp [sic to] love on said land in the house that we are now living in, is she should out-live me, until her death and the said Elmer C. Fields is to pay her rent on said land until he death, the same that he has been paying me, but neither of them shall have the right to cause the other to move neither shall she have the right to rent the land to any one else.

2. I will and bequeath all my personal property consisting principallu of money and notes to be equally divided between, my beloved sons Francis S. Fields and James. O. Fields and my beloved daughters Emma F. Peters and Ida Bloomer.

3. I hereby appoint my beloved son Elmer C. Fields as executor of this will without filling any bond.

Witness my hand and seal this the 24" day of November 1904

Daniel H. Fields

State of Indiana, Greene County, SS;

On this 15" day of May, A.D. 1917, in open court in the Greene Circuit Court, in the State of Indiana, personally came John Davidson the subscribing witnesss to the annexed foregoing instrument of writing purporting to be the last will and testament of Daniel H. Fields, late of Greene County, in the State of Indiana, deceased, who being now in open court duly sworn to testify the truth, the whole truth and noting [sic nothing] but the truth, concerning the execution of the last will and testament of Daniel H. Fields, on his oath aforesaid, testified as follows, towit:- The he saw the said Daniel H. Fields in his life-time, but who is now deceased, sign his name to the annexed and foregoing instrument of writing, as and for his last will and testament; that he heard him declare the same to be his last will and testament; and that John Davidson, affiant and Thomas Aydelotte signed their names thereto as attesting witnesses, at the request of said testator in his presence, and in the presence of each other, and that at the time he so executed said last will and testament he the said Daniel H. Fields was of full age to devise and bequeath, his property; that he was of sound and disposing mind and memory, and that he was not under the coercion or restraint of any person or persons whomsoever, and further saith not.

Subscribed and sworn to in open court, on this 15" day of May 1917.

It testimony whereof I have hereunto set my hand and affixed the seal of said court at office in Bloomfield on this 15" day of May A.D. 1917
