Will of Emma EmeryBk. 5 pg. 50-1 Know all men by these presents: That I, Emma Emery, of Bloomfield, Greene County, Indiana, being over 21 years of age, and being of sound and disposing mind and memory, and not acting under duress, menace, fraud, or under influence of any person whatsoever, do make, publish and declare the following as and for my last will and testament: and I hereby revoke and cancel all previousd wills and testamentary dispositions heretofore made by me. First - I direct that my body be decently buried with proper regard to my station and condition in life, and the circumstances of my estate. Second - I direct the payment of my funeral expenses, the expenses of my last sickness, and all of my just debts and the expenses of administration out of the property belonging to my estate. Third - All of the Rest and residue of my property of whatsoever nature, to which I, at the time of my death, may be legally or equitably entitled, or over which I may have any power of appointment, I give, givse, bequeath, and appoint unto my following children, in equal propetion and share and share alike:
Fourth - I hereby, nominate and appoint Ambrose Robert Emery executor of this my last will and testament to serve without bond and with power, during the administration of my said estate to sell or dispose of all or any part of the property thereof, real, personal or mixed without order of court and without notice, at public or private sale. >In witness whereof, I, the said Emma Emery have to this my last will and testament, consisiting of 2 sheets of paper, subscribed my name and set my seal this 17" day of May A. D. 1920
The foregoing instrument, consisiting of 2 pages, was on this 17" day of May, 1920 by the said Emma Emery, the above named testator, signed, sealed, published and declared to be her last will and testament, in the presence of us, who thereupon at her request, in her presence, and by her expressed direction and in the presence of each other, sunscribed out names as witnesses thereto, the day and year last above written.
Proof of Will State of Indiana, Green County, ss: On the, 10 day of September A.D. 1920 in open court in the Greene Circuit Court, in the state of Indiana, personally came Ambrose R. Emery who being duly sowrn says he was present and saw the testate Emma Emery, sign, in the presence of the subscribing witnesses therto the instrument of writing purporting to be the last will and testament of said Emma Emery late of Greene County, in the state of Indiana, deceased who being now in open court duly sworn to testify the truth, the whole truth and nothing but the truth, concerning the exectution of the last will and testament of said Emma Emery, deceased, on his oath aforesaid testified as follows, to-wit: that he saw the said Emma Emery in her life-time, but who is now deceased, sign her name to the annexed and foregoing instrument of writing as and for her last will and testament; that he heard her declare the same to be her last will and testament; and that Laura A. Bearcraft and Fred B. Jones, the subscribing witnesses to said will were present and signed their names thereto as attesting witnesses at the request of said testator in his presence and in the presence of each other, and that at the time she so executed said last will and testament the said Emma Emery was of full age so to devise and bequeath her property; that she was of sound and disposing mind and memory, and that she was not under the coercion or restraint of any person or persons whomsoever, and that the subscribing witnesses to said will are each now residence of the state of Indiana.
Subscribed and sworn to in open court, on this 10" day of September, 1920 >In testimony whereof, I have hereunto set my and and affixed the seal of said court, at office in Bloomfield, on this 10"day of September 1920
State of Indiana, Greene County, ss: I Meredith G. Messick, clerk of the Greene Circuit Court of Indiana, do hereby certify that the annexed and foregoing last will and testament of Emma Emery late of Greene County, deceased, has been duly admitted to probate; that its due execution was this day fully proven in open court, by the testimony of Laura A. Bearcraft and Fred A. Jones, the subscribing witnesses thereto, whos proofs, together with said last will and testament, have been duly recorded on page 50- and 51 of Will Record 5, now on file in my office. It testimony whereof, I have hereunto set my hand and affixed the seal of said court, at office in Bloomfield, on this 10" day of September, 1920
