Will of W. H. SextonBk. 5 pg. 30-1 I, W. H. Sexton, of Wright township, Greene county, Indiana, do hereby make, publish and declare, this to be my last will and testament. hereby revoking any and all former will by me heretofore made. Item 1 - I direct that all my just debts be paid as soon as possible after my decease. Item 2 - I will and bequeath to my children Naomi J. McKee, Goerge M. Sexton, and Otto H. Sexton, the sum of Five ($5.00) each. Item 3 - I will and bequeath to my wife Susan one-third (1/3) of all my property, both real and personal, of which I may die seized, subject to its proportion of my debts existing at the time of my death. Item 4 - All the remainder of my property both real, and presonal, including a life insurance policy of $1,000.00, I will and bequeath to my daughter Lulu E. Sexton, and I further direct that the said Lulu E. Sexton, shall take said property both real and personal, sell the same whenever she shall see fit, and the proceeds arising from said sale or slaes shall be divided among the children in equal parts after all expenses of administration asn [sic and] sales have been paid. Item 5 - I hereby constitute and appoint Lulu E. Sexton, executrix of this my last will and testament and designate that she shall serve without bond, and that she shall be excempt from giving sureties upon her offical bond. Item 6 - I further authorize my executor, if she deem it advisable, to sell the whole or any part of my real estate, and personal property, at public or private sale, and to execute and deliver all deeds, instruments or transfer, and other writings necessary to pass title. In witnesse whereof I have hereunto set my hand and seal this 25" day of February, 1920
State of Indiana, Greene County, ss: On this 15" day of April A.D. 1920, in open court in the Greene Circuit Court, in the State of Indiana, personally came Oscar R. Shields one of the subcribing witnesses to the annexed foregoing instrument of writing purporting to be the last will and testament of W. H. Sexton late of Greene County, in the State of Indiana, deceased, who boing now in open court duly sowrn to testify the truth, the whole truth and nothing but the truth, concerning the execution of the last willand testament of W. H. Sexton, deceased, on his oath aforesaid, testified as follows, towit: That he saw the said W. H. Sexton in his life-timie, but who is now deceased, sign his name to the annexed and foregoing instrument of writing, as and for his last will and testament; that he heard him declare the same to be his last will and testament; and that Oscar R. Shields, this affiant and H. M. McDaniel signed their names thereto as attesting witnesses, atht he request of sais testator in his presence, and in the presence of each other, and that at the time he so executed said last will and testament he the said W. H. Sexton was of full age ato devise and bequeath his property; that he was of sound and disposing mind and memory, and that he was not under the coercion or restraint of any person or persons whomsoever, and further saith not.
Subscribed and sworn to in open court, on this 15th day of April A. D. 1920. In testimony whereof, I have hereunto set my hand and affixed the seal of said court, at office in Boloomfield on this 15" day of April A.D. 1920
State of Indiana, Greene County, ss: I, Meredith G. Messick, Clerk of the Greene Circuit Court of Indiana, do hereby certify, that the annexed and foregoing last will and testament of W. H. Sexton late of Greene County, deceased, has been duly admitted to probate; that its due execution was ths day fully proven in open court, by the testimony of Oscar R. Shields one of the subscribing witnesses thereto, whose proofs, together with said last will and testament have been duly recorded on page 30 of Will Record No. 5 now on file in my office. In testimony whereof, I have hereunto set my hand and affixed the seal of sais court, at office in Bloomfield, Indiana on this 15" day of April A.D. 1920
