Will of Mary A. Fainot



Bk. 6 pg. 72

I, Mary A. Fainot, of Linton, Greene, State of Indiana, do hereby make and publish this my last will and testament and do hereby revoke any and all wills by me heretofore made.

Item 1 - I will and direct that all my just debts, including last sickness and funeral expenses be paid.

Item 2 - I will and direct that a suitable monument be erected at my grave; also a suitable monument at the grave of Laban Albert Huey, my son by a former marriage.

Item 3 - I devise and bequeath to James C. Huey, the sum of Two hundred dollars.

Item 4 - I devise and bequeath to Laurette Smith the sume of two hundred dollars.

Item 5 I devise and bequeath the residue and remainder of my estate real and personal or mixed of whatsoever kind to Mary A. Rrchardson [sic Richardson] and Stella B. Huey in equal portions.

Item 6 - I nominate and appoint Gilbert H. Combs executor of this my last will and tetsament and do hereby revoke and and all wills by me hereuntofore made.

In testimony whereof, I do hereynto set my hand and seal this the 18th day of October, 1923.

Signed by the said Mary A. Fainot in our presence and by her declared to us to be her last will and testament and signed by us in her presence at her request and in the presence of each other this 18th day of October, 1923.

State of Indiana, Greene County, ss:

On this day of June A.D. 1931, in open court in the Greene Circuit Court, in the State of Indiana, personally came Bertha A. Crane, on of the subscribing witnesses to the annexed foregoing instrument of writing purporting to be the last will and testament of Mary Ann Fainot, late of Greene County, in the State of Indiana, deceased, (who departed this life on the 17 day of May, 1932) who being now in open court duly sworn to testify the truth, the whole truth, and nothing but the truth, concerning the execution of the last will and testament, of Mary A. Fainot, deceased, on her oath as aforesaid, testified as follows, to-wit: That she saw the said Mary A. Fainot in her life-time, but who is now deceased, sign her name to the annexed and foregoing instrument of writing, as her last will and testament; that she heard her declare the same to be her last will and testament; and that Bertha A. Crane affiant Leone D. Hudson signed their names thereto as attesting witnesses, at the request of said testatrix in her presence, and in the presence of each other, and that at the time she so executed said last will and testament, that said Mary Ann Fainot was of full-age to devise and bequeath her property; that she was of sound and disposing mind and memory, and that she was not under the coercion or restraint of any person or persons whomsoever, and further saith not.

I, Elmer W. Sherwood, Clerk of the Greene Circuit Court of Indiana, do hereby certify that the annexed and foregoing last will and testament of Mary A. Fainot, late of Greene County, deceased, has been duly admitted to probate; that is due execution was this day fully proven in open court, by the testimony of Bertha A. Crane, the subscribing witness hereto, whos proofs together with said last will and testament, have been duly recorded on page 72, Will records No 6 now on file in my office.

In testimony whereof, I have hereunto set my hand and affixed the seal of said court, at office in Bloomfield, Ind. on the 20 day of June A.D. 1931
