Jackson County, Indiana Probate Order Book Vol. 3. 15 Jan 1866 - 23 May 1868 submitted by: Susan Stohl Names and family relationships extracted from Jackson County, Indiana 1866 Probate Records from the Court of Common Pleas. The Court of Common Pleas handled non-criminal cases. Typically a guardian /administrator who wanted to sell property belonging to wards appeared in court with an appraisement of the property. The appraisers are usually named. Based on the valuation of the real estate, the guardian/administrator had to post a bond that was double the value of the land. The men or women securing the bond are named. The property had to be advertised and sold for not less than 2/3 of the valuation. Surviving widows were "set off" if the value of their deceased husband's estate was less than $300, meaning that no letters of administration were ordered and the whole of the estate fell to the widow.
