I, Nicholas L. Baker, being of sound mind and disposing memory, do
make, publish and declare the following as my last will and testament.|
I bequeath to my wife Elizabeth Baker, all my personal estate of every kind and character and description, wherever the same may be situated to be her property absolutely and forever.
I have heretofore conveyed to my son Otaway A. Baker, all my real estate, and for that reason he is given nothing by this will.
I nominate my son, Otaway A. Baker, as executor of this my will.
In testimony whereof, I have hereunto set my hand and seal this _____ day of April, 1915.

Before me, Charles W. Runyon, Clerk of the Martin County Circuit Court, personally came Azor C. Smith, one of the subscribing witnesses to the foregoing last will and testament of Nicholas S. Baker, late of Martin County, Indiana, deceased, and being duly sworn on oath says that he was present at the execution of said last will, that the same was duly executed, that at the time of the execution thereof, said testator was of full age to devise his property, of sound mind and memory, and not under any coercion or restraint, that said testator requested Azor C. Smith and Amanda Smith to sign said will as witnesses thereto, which they accordingly did in the presence of said testator and in the presence of each other as subscribing witnesses thereto.

I, Charles W. Runyon, clerk of the Martin Circuit Court do hereby certify that the above and foregoing last will and testament of Nicholas S. Baker, late of Martin County, State of Indiana, deceased, was this day duly admitted to probate and record, and the proof thereof duly made by Azor C. Smith, one of the subscribing witnesses thereto, which said will, together with such proof, have been duly recorded in Record of Wills No. C, page 393, in this office.

File note: Nicholas was married first to Dicy Duncan, who died 3/24/1913. Nicholas died 2/14/1918. They had one child, Otoway, the executor of this will. See the will of Elizabeth M. Baker
