WEAVER, CANADAY, CUSTARD

--Mahlon WEAVER appears first in Rush County, Indiana General Marriage Records and Marriage Records for period including year 1829. Married Kendecia Kenaday on 6/11/1829 by Justice of Peace, FHL Film #1,630,369 and #1,630,188(v.2, p.134). Rush County Circuit Court's records show Maland (spelling of name on application and marriage record)and Kendecia acquired a marriage application on 8 Jun 1829. Marriage record shows Maland being of (from) Fayette County, IN and Kendecia being from Rush County, IN.

Enumerated in 1830 Census, Fayette County, Indiana under age category 20-30 with female 15-20. These ages correspond with year of birth of 1808 for Mahlon and 1810 for first wife Candace CANADAY(Kendecia Kenaday). Name spelled Malen in 1830 Census.

Mahlon's second wife, Harriet CUSTARD, acquired 160 acres of land in a cash-entry sale from the federal government on 6 Jun 1832 in Montgomery County, Indiana. NE Sec 21, Township 19N, Range 3-W. If this is Mahlon's 2nd wife, she would have been 16 when she acquired this land.

Mahlon acquired 80 acres of land in a cash-entry sale from the federal government on 5 Aug 1834 in Henry County, Indiana. E1/2SE Sec 32, Township 16-N, Range 11-E. Application indicates that he was of (from) Fayette County, Indiana.

He was enumerated in 1840 Census in Henry County, Dudley Township, age category of 30-40 with female 20-30, with children: male-under 5 (1), 5-10 (2); female, under 5(1). All ages correspond with family records except 1 male under 5, Albert Elias born 11 Sep 1841. Name spelled Malen in 1840 Census.

He sold 20 of original Henry County 80 acres on 27 Dec 1841 to Christopher Comiday (sp) of Henry County, Indiana. Candace signed (marked with an X) the Grantor/Grantee Deed. Sold remaining Henry County 60 acres on 3 Mar 1847 to Isaac Hendricks of Rush County, Indiana. Candace signed (marked with an X) the grantor/grantee deed.

Family records indicate that Candace died on 7 Sep 1847 in Crawfordsville, Montgomery, IN, however not able to find any evidence to support death date and place. Mahlon married Harriet Custard Hipes 30 Apr 1948 in Crawfordsville, IN. Purchased 31.28 acres in Montgomery County from John Lockridge for $1,400.00.

He was enumerated in 1850 Census in Montgomery County, Union Township. All children and ages correspond with family records except the three children noted below. Occupation listed as farmer. Harriet Custard listed as wife. Mahlon shows Virginia as birthplace, Harriet shows Kentucky as birthplace. Minerva, 1st child of Mahlon and Harriet, who was born 12 Jul 1850 was listed. John Newton Weaver, 2nd child of Mahlon and Candace, was listed. Family records indicates he died in 1844. Two female children listed in order after Mahlon's children; Sorelda A., age 13, and Ann M, age 10. These are Harriet's children from previous marriage to Charles Hipes.

Mahlon was enumerated in 1860 Census in Montgomery County, Union Township (Crawfordsville Post Office). Occupation listed as farmer. Mahlon now list Kentucky as birthplace instead of Virginia. Also, children Jasper and Jefferson, birthplace listed as Kentucky. Thomas Benton (son) listed as Benton.

He was enumerated in 1870 Census in Montgomery County, Union Township. Occupation listed as miller. Mahlon's birthplace listed as Kentucky. Specified that his father was foreign born. Thomas Benton Weaver, age 18, is noted as farm laborer. Female child Louisa, age 6, listed in census is not on family records. Lydia is not listed in Census. Family records shows 1861 as year of birth for Lydia. Assuming the date of birth is off by three years, Louisa and Lydia are most likely the same person.

Mahlon died In March 1875 in Crawfordsville, IN and was buried in Lee Cemetery. Court probated personal estate to his widow Harriet. Personal estate value was appraised at $164.25. Items consisted of farm equipment and household items. The 14.62 acres of land owned by Mahlon was appraised at the same value of the mortgage of $364.00. Apparently Harriet was left with no place to live.
