David Finley Agreement with Cyrus Finley,

This Indenture made and entered into this fourth day of October in the year of our Lord one thousand eight hundred and forty five between David Finley and Cyrus Finley both of the County of Orange and State of Indiana witnesseth that the said David Finley have leased or let and by these presents doth lease or let to the said Cyrus Finley his heirs and assigns the south west and north west Quarters of Section three in Township (2) two north of Range one East lying and situate in the said County of Orange it being the tract of land on Which I formerly resided to have hold use occupy and enjoy the said premises together with appurtenances thereof or thereto belonging to the only proper use benefit and behoof of the said Cyrus his heirs or assigns together with the rents profits issues and also all back rents that now is as may here after become due for said farm as tract of land for and during the term of six years from the ninth day of Oct last past said Term of years to be fully ended and completed on the ninth day of Apl one thousand eight hundred and fifty one and also all the notes of hand as obligations for money executed to me in the month of January 1835 in consideration of the sale of my personal property and I hereby assign and transfer all my rite and title to each of said notes to the said Cyrus Finley and I the said Cyrus on my part doth bind and oblige myself to take good care of and provide a comfortable living for the said David Finley during his life and I also agree to pay for one year schooling for Elizabeth Finley and one year for Samuel Finley heirs of Jefferson Finley dec provided their parents will send them to school I also bind myself to pay the State and County taxes on the above described tract of land during the term for which I leased them and to plant the cleared land on said premises one year in corn and save it the next in small grain to deliver the same at the end of my lease in reasonable good repair and I am not to waist or destroy the timber on said premises more than what is necessary for the use of said farm I further agree not to box or ??? any Sugar trees south of the most southern field on the premises and I also bind myself to enclose with a brick wall the graves of my Father and Mother and of my Brother Jefferson Finley as witness our hands and seals the day and date above written.
