This Indenture made this eleventh day of April in the year of our Lord one thousand eight hundred and thirty four between William Kilgour Sheriff of the county of Parke in the State of Indiana of the first part and Michael Wilkins of the county and state aforesaid of the second part.  Witnesseth that whereas heretofore towit on the twenty sixth day of November in the year of our Lord one thousand eight hundred and thirty three an execution of writ of fieri facias issued from the Office of the Clerk of the Parke Circuit Court against John Haydon and John Holstead his security in favour of Michael Wilkins which saw writ of fieri facias with the sheriffs return thereon made said in the works and figures following towit.  Sheriff of Indiana Parke County of the State of Indiana to the Sheriff of said county Greeting.  We command you that of the goods and chattels lands and tenements of John Haydon and John Holstead his security which may be found in your bailiwick you cause to be made the sum of forty four dollars and twenty three cents in damages which Michael lately in circuit court before our judges in Rockville Recovered against the said John Haydon in an appeal from a Justice of the Peace and also the sum of six dollars and eighty three cents which in our same Court and before our same Judges was adjudged to the said Michael Wilkins for his cost and charges by him about his suit in that behalf expended and for the payment of which said sums of money the said John Holstead has become subject to execution by entering and acknowledging himself bail for the payment thereof according to the statute in such case made and provided and of which they are convicted as appears to us of record and also sixty two cents of this writ and all interest and costs accruing and to accrue thereon and have you that money ready at the office of the clerk of the Parke Circuit Court at Rockville on the third monday of February next and have then and there this writ.  Witness John G. Davis Clerk of said court at Rockville November the 26th 1883.  John Davis Clerk.  Received 26th November 1883 and on the 18th December executed lot number seventy nine and lot no. 147 in Montezuma sold lot no. 79 to Saml Hill for ten dollars and applied it his execution lot no. 147 to Michael Wilkins for ten dollars on the 13th Feb 1834 and ... property found 17th Feb 1834.  Now therefore the said William Kilgore Sheriff as aforesaid for and in consideration of the said sum of ten dollars to me in hand paid by the said Michael Wilkins the receipt whereof is hereby; acknowledged and by virtue of the writ of fieri facias aforesaid in conformity with the statute of said state in such cases made and provided have given granted bargained sold and conveyed and by these presents do hereby give grant sell and convey to the said Michael Wilkins and to his heirs forever as a perfect and indefeasible estate of inheritance

 

the aforesaid described tract of land towit together with all and singular the privileges and appurtenances thereunto belonging or in anywise appertaining and I do hereby covenant promise and agree to and with the said Michael Wilkins that I will forever warrant the same as sheriff as aforesaid from the claim or claims of any and all persons.  In testimony whereof I have here unto set my hand and seal at Rockville the day and year above written.

State of Indiana Parke County  Be it remembered that on this day towit the 11th day of April 1834 personally appeared before John G Davis the Recorder of Said County William Kilgore and acknowledged the signing and sealing said deed as Sheriff as aforesaid for the purposes therein set forth.  In witness whereof I hereunto set my hand and seal the date afixed.
