Michael Wilkins

 

            Final record of the estate of Michael Wilkins, Deceased, Be it remembered that on the Twelfth day of July in the year of our Lord one thousand eight hundred and forty seven, in vacation of our said court Letters of administration were granted by the Clerk thereof to Samuel Wilkins and George Wilkins on the estate of the said Michael Wilkins, deceased, the said Samuel and George Wilkins having first filed their bonds conditioned according to law, in the penalty of Sixteen hundred dollars with I Tilliman their security thereon, which bond and letters; and oath of the said administrators read in the words and figures following towit:  Know all men by these presents, That we, Samuel Wilkins and Isaac Tilliman of the County of Parke and State of Indiana, are held and firmly bound unto the State of Indiana in the penal sum of Sixteen hundred dollars,m lawful money of the United States, to the payment whereof, well and truly to be made, we find ourselves , our heirs, executors, and administrators, jointly and severally, firmly, by these presents,sealed with our seals, and dated this 12th day of July, Anna Domini 1847.  The condition of the above obligation is such, that if the above ?, Samuel Wilkins, shall diligently and faithfully execute the duties and trusts committed to him as joint administrator of the estate of Michael Wilkins late of the County of Parke and State of Indiana, deceased, and obey all orders and decrees of the Probate Court of the said County of Parke, made pursuant to law, touching the administration of the said estate of the said Michael Wilkins, deceased, entrusted to him as aforesaid, then the above obligation to be void; otherwise to remain in full force and ? in law.  Taken, signed, and sealed before and approved by me in vacation of said court the day and year above written, John Davis Clerk.                                               Samuel Wilkins

            Know all men by these presents, that we, George Wilkins and Isaac Tilliman of the County of Parke and State of Indiana, are held and firmly bound unto the state of Indiana the penal sum of Sixteen hundred dollars, lawful money of the United States, payment whereof, well and truly to be made, we bind ourselves, our heirs, executors, and administrators jointly and severally firmly, by these presents, sealed with our seals and dated the 12th day of July, Anna Domini 1847.  The condition of the above obligation is such that if the above bounden, George Wilkins, shall diligently and faithfully execute the duties and trusts committed to him as joint administrator of the estate of Michael Wilkins late of the County of Parke and State of Indiana, deceased, and obey all orders and decrees of the Probate Court of the said County of Parke, made pursuant to law, touching the administration of the said estate of the said Michael Wilkins, deceased, entrusted to him as aforesaid, then the above obligation to be void; otherwise to remain in full force and ? in

I John G Davis, Clerk of the Probate Court, in and for the county and State aforesaid, do hereby certify that administration of the Goods, chattels, rights, credits, Moneys and Effects, which were of Michael Wilkins, late of Parke County, deceased, who died intestate, is granted to George Wilkins and Samuel Wilkins; and the said George Wilkins and Samuel Wilkins having qualified and given bond as such administrators are duly authorized to take upon themselves the administration of such estate, according to law.

State of Indiana Parke County .  We do solemnly swear that the foregoing inventory is in all respects just and true, and contains a full statement of all the property, notes, accounts, cash, Bank notes and other circulating medium belonging to the estate of Michael Wilkins, deceased, which have come to our hands: and that no bonds Mortgages, other securities or debts in favor of said estate have come to our hands to be administered and further say not.  George Wilkins  Samuel Wilkins

            And afterwards towit at a term of said court begun and held at the court house aforesaid on the second monday being the Thirteenth day of September in the year of our Lord one thousand eight hundred and forty seven, before the Hon John Marshall Judge thereof and on Thursday the fourth day of the term, t;he same being the sixteenth day of the said month, Comes John G Davis, Clerk of this court by whom Letters of Administration were granted in the last vacation to Samuel Wilkins and George Wilkins, on the estate of said deceased, and reports all his proceedings on the premises, by producing to the court here the records of his proceedings, which being examined by the Court is approved and confirmed, and adopted as the acts of this court; and further that the bonds taken by said Clerk from said administrators for the faithful performance of these duties be approved. And afterwards towit the administration filed the following sale Bill towit; and this case is continued.  An account of the sales of the personal property of Michael Wilkins, deceased, Late of Reserve Township Parke County and State of Indiana sold on the 20th day of August A.D. 1847.  On a credit of Twelve months where the amount was upwards of Three dollars under Three dollars cash in hand,

            And afterwards towit at a term of said court begun and held at the court house aforesaid on the second monday being the Twelfth day of June in the year of our Lord one thousand eight hundred and forty eight, before the Hon John Marshall Judge thereof and on Saturday the sixth day of the term, the same being the Seventeenth day of said month; On motion this case is continued

            And afterwards towit at a term of said court begun and held at the court house aforesaid on the second monday being the Eleventh day of December in the year of our Lord one thousand eight hundred and forty eight before the Hon John Marshall Judge thereof and on Wednesday the ninth day of the term, the same being the Twentieth day of the said month; On motion this cause is continued

            And afterwards towit at a term of said court begun and held at the court house aforesaid on the second monday being the Twelfth day of March in the year of our Lord one thousand eight hundred and forty nine, before the Hon John Marshall Judge thereof and on Wednesday the ninth day of the term, the same being the Twentyfirst day of the said month; On motion this case is continued

            And afterwards towit at a term of said court begun and held at the court house aforesaid on the second Monday being the Eleventh day of June in the year of our Lord one thousand eight hundred and forty nine before the Hon John Marshall Judge thereof and on Wednesday the ninth day of the term, the same being the Twentieth day of the said month; On motion this case is continued

            And afterwards towit at a term of said court begun and held at the court house aforesaid on the second monday being the Tenth day of September in the year of our Lord one thousand eight hundred and forty nine, before the Hon John Marshall Judge thereof and on Tuesday the second day of the term, the same being the Eleventh day of the said month; Comes George Wilkins and Samuel Wilkins, administrators and file an account current upon the administration of said estate verified by affidavit as follows towit:  The report of Samuel and George Wilkins, Administrators of the Estate of Michael Wilkins, deceased showeth that there have come to their hands, the following sums, towit;

The said George Wilkins has received as an advancement as above $600.  From which deduct 201.80 his Share as an heir leaves the  sum of $398.20 owing to said heirs which he has paid by giving them his notes, now here shown to the court, as follows towit:

The said George makes no charge for his services the business having ben transacted by Samuel mainly.  The Administrators having fully Administered and accounted for al the assets which have come to their hands, pray that this settlement ma;y be in all things confirmed, and that they may be discharges from all further responsibility.

Which being examined by the court is approved, and the several claims therein mentioned are allowed:  And it is on motion further ordered, that this be taken as a final settlement of said estate and the said administrators are hence discharged.

The State of Indiana, to eh Sheriff of said County, Greeting:

Whereas Martha Wilkins, widow of Michael Wilkins, deceased, to George Wilkins, Samuel Wilkins, Joseph D Russell, Nancy Russell his wife, formerly Nancy Wilkins, John Tinbrook and Mary W. Tinbrook his wife, formerly Elizabeth Wilkins, Benjamin Rankins, and Martha E Rankins his wife, formerly Martha E Wilkins, heirs at law of said deceased, have filed in the probate court of said county their petition against John Wilkins also an heir at law of said deceased in which they allege that the said Michael, deceased, was at the time of his death seized in fee of the E 1/2 SW 1/4 Sect 19 T 16 N R 8 W Containing 80 acres. The W fr. SW 1/4 Sec 19 T 16 N R 8 W containing 118 28/100.  Twenty Six acres off the N end E 1/2 of the NE 1/4 Sec 25 T 16 N of R 9 West: 54 acres off the S end of the E 1/2 SE 1/4 Sec 24 Town 16 R 9 W.  Also Lot 148 in Montezuma in Said County and praying the Court to appoint Commissioners pursuant to the statute in Such cases made and provided, to assign and Set off to the Said Martha Wilkins her dower on Said lands and tenements, and to make partitionof the residue of said tracts of land and Town lot with their appurtenances among the Said Several heirs at law of said deceased and further that that part of said Lands improved by Said Samuel Wilkins Shall be valued as if no improvements were made thereon, and that Said Samuel Shall have his Share of Said land Set off to so include Said improvements made sy Said Samuel on Said land.

            We therefore command you to Summon the Said John Wilkins, if he may be found in your Baliwick personally to be and appear before our judge and our probate court to be holden at the Court House in Rockville on the 2nd Monday in December next insuring then and there in said court to plea answer on demand to said petition, hereof the Said John will in ____ fail at his part, and have you then there this writ,

            We therefore command you that you proceed without delay, after being first duly sworn according to law to assign and set over to the said Martha Wilkins her dower of and in the real estate, aforesaid, towit: The E frac. SW 1/4 Sec 19 T 16 N R 8W containing 80 acres.  The W frac.
