MARTHA RANKINS (WILKINS) - MAY 1848

DEED BOOK

 

 

This Indenture made this sixth day of May eighteen hundred and forty eight, between Benjamin Rankins and Martha Rankins his wife of the County of Fountain and State of Indiana of the first part, and Samuel Wilkins of the count of Parke and State of Indiana of the second part Witnesseth; That the said Benjamin Rankins and Martha his wife for and in consideration of the sum of six hundred dollars to them in hand paid by the said Samuel Wilkins, the receipt whereof they do hereby acknowledged have bargained, granted, sold, conveyed and confirmed and do by these presents, grant, bargain, sell, convey and confirm unto the said Samuel Wilkins his heirs and assigns forever, all the Estate, right, title, interest and claim of the said Benjamin P. Rankins and Martha his wife in and to the following pieces or parcel of lands, lying situate and being in the county of Parke and State of Indiana, the same being the lands of which Michael Wilkins late of said County died seized, and the said Benjamin P. Rankins and Martha his wife are seized of one seventh part by virtue of their right as heirs at law of the said Michael Wilkins, deceased towit; part of the East fraction of the South West quarter of section nineteen in township sixteen of Range Eight West, in the district of lands offered for sale at Crawfordsville Indiana, fifty four acres: Also the one seventh East half of the South East quarter of section twenty four in Township sixteen North of Range nine West, in the district of Terre Haute State of Indiana: also the one Seventh part of the West fraction of the South West quarter of section Nineteen, in Township sixteen North of Range Eight west in the District of Lands at Terre Haute and State of Indiana, containing one hundred and eighteen acres and twenty eight hundredths of an acre: also all their right title and claim in twenty acres off the North end of the East half of the North East quarter of section twenty five, township sixteen North of Range nine West in the district of Terre Haute, State of Indiana: Also Lot No three in the partition of the land of the said Michael Wilkins Decd amongst the heirs of the said Michael Wilkins as by the report of the commissioners on file in the Probate Court of said County will more fully appear.  Together with all the rights, privileges and appurtenances thereunto belonging.  To have and to hold the messuage and lands aforesaid with the appurtenances unto the said Samuel Wilkins his heirs and assigns forever, to his and their proper use benefit and behalf so that neither the said Benjamin P. Rankin, nor Martha his wife nor their heirs or assigns, nor any other person or persons for him or them or in his or their name or right shall or may by any ways or means whatsoever at any time hereafter claim or demand any estate, right or interest in or to the said messuage lands and premises or any part or parcel thereof they and each and every of them shall be forever barred by these presents: and the said Benjamin P Rankin and Martha his wife and their heirs the said land and premises with the appurtenances to the said Samuel Wilkins his heirs and assigns, and against all other persons whomsoever will forever warrant and defend.  In witness whereof the said Benjamin P. Rankins and Martha his wife have hereunto set their hands and seals this sixth day of May 1848

            On this day towit; the 6th day of May 1848 personally came before me a justice of the peace of said county the above named BP Rankins and acknowledged that he signed, sealed and delivered the foregoing warrantee Deed to be his voluntary act and deed for the uses and purposes therein contained; and also personally came before at the same time and place Martha Rankins wife of the said BP Rankins and being by me first duly examined separate and apart from, and without the hearing of her said husband and the full contents and purports thereof being fully made known and explained to her, did acknowledge that she did sign, seal and deliver the same, freely and voluntarily and without any compulsion or coercion on the part of her said husband.
