   This Indenture made this thirteenth day of August in the year of our Lord, one thousand eight hundred and fifty one between James W. Beadle Sheriff of the County of Parke in the State of Indiana of the first part and George Wilkins of the County and state aforesaid of the second part.  Witnesseth that whereas Elias G. Holliday lately before the judges of the Parke Circuit Court held in Rockville in said County of Parke towit: at the October Term of said court in the year of our Lord one thousand eight hundred and fifty recovered by the judgement of said Court against Lewis Thomas the sum of forty dollars and twenty one cents for the costs and charges of him, the said Ellias G. Holliday expended in his defence in a certain action assumpsit? theretofore pending on the Parke Circuit Court brought by the said Lewis Thomas against the said Elias G. Holliday: on occasion of the continuance of said cause by the plaintiff at the October Term of said Court in the year of our Lord one thousand eight hundred and fifty as by the record thereof remaining in said court more fully appears.  And whereas afterwards to wit: on the twenty sixth day of November A.D. 1850 the said Elias Holliday sued out a certain writ of execution on said judgement directed to the said James W. Beadle as aforesaid by which said writ the said Sheriff was commanded that of the goods and chattels lands and tenements of the said Lewis Thomas which might be found in his bailiwick he should cause to be made the costs aforesaid and have the money ready at the office of the Clerk of said Court at Rockville at the expiration of one year from the date of said writ to return to the said Elias G. Holliday and have then there that writ:

   And whereas afterwards to wit: on the fourteenth day of January in the year of our Lord one thousand eight hundred and fifty one the said James W. Beadle Sheriff as aforesaid returned in obedience to said writ; he levied upon the land herein after described as the property of said Lewis Thomas and having advertised the same according to law by publication three weeks successively in the Parke County Whig prior to the ? day of February A.D. 1857 the day of sale, and by setting up three notices in three of the most public places in the Township where in the landlaid and one at the Court House door in Roickville and said Land being duly appraised by Lorenzo Orvis and Alexander Lurgbaugh two disinterested freeholders of said township at the sum one hundred and twenty five dollars and the rents and profits for seven years at the sum of twenty five dollars and on the said fifteenth day of February A.D. 1857 he be at the Court House door in Rockville Parke County between the hours of ten o'clock AM and four o'clock PM on said day to offer for sale at public auction and out cry?.  first, the rents issues and profits of said land for the term of seven years and no person offering bid therefore he then and there in like manner offered for sale the fee simple in said land and George Wilkins bid therefor the sum of one hundred and thirty two dollars and that being the highest and best bid offered for the same and he being the highest and best bidder therefore the said land was then and there by the said James W Beadle Sheriff as aforesaid openly and in due form of law struck off and sold to the said George Wilkins for the aforesaid sum of one hundred and thirty two dollars.

   Now therefore to confirm to the said George Wilkins the sale is made as aforesaid to consideration of the premises and for and in consideration of the aforesaid sum of one hundred and thirty two dollars to him paid by the said George Wilkins doth hereby grant bargain sell and convey unto the said George Wilkins his heirs and assigns forever all that tract or parcel of land lying and being in the county of Parke and known and designated as being in the county of Parke and known and designated as being the East half of the North West fractional quarter of section five (5) Township seventeen (17) North of Range eight (8) West together with all privileges profits and appurtenances thereunto belonging and all the estate right title interest and claim of the said Lewis Thomas in and to the same in any part thereof.  To have and to hold the premises aforesaid with all the appurtenances to the said George Wilkins his heirs and assigns forever in as full and ample a manner as the said Lewis Thomas had and held the same immediately before the rendition of the judgement aforesaid.

            Personally came before the undersigned a Justice of the Peace within and for the County of Parke James W Beadle the grantor in the within conveyance, and acknowledged the signing, sealing and delivering of the same to be his voluntary act and deed for the purposes therein mentioned.  Given under my hand and seal this the 30th day of August A.D. 1851
