Uriah Allen

Know all men by these presents that I, Uriah Allen of Putnam County and State of Indiana, being of sound mind though weak in body and knowing the certainty of death and the uncertainty of life Do make this my last will and testament revoking all others. First: I give and bequeath to my wife Frances Allen (after my just debts are paid) all of that land or a parcel of land described to wit: The west half of the north west ? of section twenty six ? fifteen Range thru West to have and to hold with all the appartures therewith afforded during her life. Also I give and bequeath unto my wife all my personal property during her widowhood and in case she should marry then two thirds of my personal property shall be sold among my lawful begotten children as hereafter divided. Second I give and bequeath unto my son William Allen the sum of ten dollars. Thirdly, I give and bequeath unto my three other children, viz Zachariah Allen, Harriet Allen and Sarah Margaret Allen all my property, both personal and real after the death of my wife Frances Allen but in case Carter? F Nicholson shall not will at his death property enough to my son William Allen to make him equal in worth with my other children then he the said William Allen shall have of my property sufficient to make him equal in worth with my other three children above named. Fourthly and lastly I constitute and append my wife Frances Allen and Harry? Collins my executors as whereof I hereunto affixed my hand and seal this 17th of March A.D. 1844.

Be it known that on the 6th day of August 1844, personally came before me William S Townsend Clerk of the Putnam County Indiana Probate Court. Alexander Dunnington and William Wise of said county who being first duly sworn the said first named deponent upon his oath deposes and says that the within instrument of writing dated the 17th day of March 1844 and purporting to be the last will and testament of Uriah Allen by the said Uriah Allen the testate therein named on the day and year the same bears date that the lines of signing the same these deponents say that the said testator was of lawful age to devise his property and of sound mind and memory and under no coercion or ? whatever that at the time of signing the same the said first named deposed says the same was ? read over to the said testater who in the ? of the said first named of these deponents declared the same to be his last will and testament that at the time of ...
