James McCurdy's Will

I James McCurdy of Washington Township, Putnam County, Indiana, a Farmer, make this my last will. I give, devise and bequeath my estate and property real and personal as follows, that is to say: to my wife Sarah McCurdy her lifetime after her death, Samuel McCurdy is to have fifty dollars, Mary E. Hice is to have twenty five dollars, Julyann Rice's heirs namely Elza Rice and William to have five dollars, the remainder to be equally divided between Robert McCurdy and William B. McCurdy each heir to have his share within two years after the death of Sarah McCurdy. I appoint Sarah McCurdy executor of this my will, in witness where of have signed and sealed and published and declared this instrument as my will at my home Washington Township, Putnam County, Indiana

The said James McCurdy at said Washington Township, Putnam County on same day of May 1879 signed and sealed this instrument and published and declared the same as and for his last will and so at his request and in his presence, and in the presence of each other have hereunto written our names as subscribing witnesses.

The State of Indiana, Putnam County SS: Be it remembered that on the 24th day of May AD 1879, George W. Johnston one of the subscribing witnesses to the within and foregoing last will and testament of James McCurdy late of said county deceased personally appeared before the undersigned clerk of the Circuit Court of Putnam County in the State of Indiana, and being duly sworn by the Clerk of said Court, upon his oath declared and testified as follows, that is to say: that on the 3d day of May AD 1879 Said James McCurdy acknowledged his signature in said instrument as his genuine signature to said instrument in writing as and for his last will and testament and this deponent at the same time heard the said James McCurdy declare the said instrument in writing to be his last will and testament, and that the said instrument in writing was at the said time at the request of the said James McCurdy and with his consent attested and subscribed by the said deponent and Scott Earnhart, in the presence of said testator and in the presence of each other as subscribing witnesses thereto.

And that the said James McCurdy was at the time of the signing and subscribing of said instrument in writing as aforesaid of full age (that is more than twenty one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint as the said deponent verily believed, and further deponent says not.

I, Moses D. Bridges Clerk of the Circuit Court of Putnam County, Indiana, do hereby certify that the within annexed will and testament of James McCurdy has been duly admitted to probate, and duly proved by the testimony of George W. Johnston one of the subscribing witnesses thereto, that a complete record of said will and of the testimony of the said George W. Johnston in proof thereof has been by me duly made and recorded in Book No. 2 at pages 294 & 295 of the record of wills of said county, in attestation whereof I have hereunto subscribed my name and affixed the seal of said Court at Greencastle* the 24 day of May 1879.
