Archibald Miller

This is a transcription of the will of ARCHIBALD MILLER. I have a photocopy in my file that was obtained from the Clerk of Courts Office in the courthouse in Greencastle, Putnam County, Indiana. The Will is recorded in Book No. 2 Pages 439 to 441 of the “Record Of Wills” which covers the period from November 1868 to July 1889.
Some of the handwriting is difficult to read, I have attempted to reproduce it as written. If there is a word or words that I can not read this has been indicated with a question mark (?).
This Will was apparently written February 15 1879, which was a little over 5 years before his death.


Archibald Millers Will

In the name of the Architect of the Universe, I Archibald Miller of Putnam County and State of Indiana being in fair health and feeling my time short for this world, yet being of sound and disposing mind, and it being my sincere (?) wish and intent to arrange my worldly matters while in possession of that blessing do make and publish this my last Will and testament.

Item First I request after my demise that all my just debts be paid from the proceeds of such property as I may die (???) with.

Item Second. That the remainder of all of my personal property after said debts are paid be turned over to my daughters Susan Miller, Mary Jane Miller and Sarah Elizabeth Miller to use, control,sell or dispose of the same as they may see fit and (???)

Item Third. It is provided further that my daughters above named to whit Susan Miller Mary Jane Miller and Sarah Elizabeth Miller have the use ? and profits of all my real estate the farm I now reside on in the County of Putnam and the State of Indiana containing eighty acres be the sum more or less, to use and occupy during their natural lives, provided that at the death of either of said daughters, then the surviving daughters shall (?) and take the deceased daughters interest in the Real estate (?) Farm and provided further that at the death of any one of the surviving daughters then the last surviving daughter shall have the control and use (?) (?) profits of all my Real estate an Farm above described as much as and in lieu of the deceased daughters an daughters during her natural life.

Item Fourth It is further provided that at the death of all my said daughters Susan, Mary Jane and Sarah Elizabeth that my real estate above described be divided equal between my children Abner Miller, Louisa Figg, Thomas J. Miller, Ellen Monnett and my Grand children Marion Morton Miller son of my deceased son Samuel Miller and Charles Edwin Howell son of my deceased daughter Angalina

Item Fifth It is my Will and intention to (?) provide for my said daughters Susan, Mary Jane and Sarah Elizabeth during their natural lives, therefore it is my Will that should said daughters contract debts for necessaries of life and at their death they should not have a sufficient amount of property to pay all such just debts then it is further provides that a sufficient amount or my real estate be sold to pay said debts.

Item Sixth. I do hereby revoke all former Wills by me made.

In testimony here of I have herewith set my hand and seal this 15th day of February A D 1979
