Will of Edward R(eynolds) Miller, decd.

Will Book 3, pp. 555-558, Putnam Co. , IN, transcribed by Sharon Bryant,3rd great granddaughter of Edward R. Miller and Mariah Toney Miller.

I, Edward R. Miller, of Putnam County, Indiana, being of sound and disposing mind and memory, being desirous of arranging my worldly affairs, hereby make and publish this my last will and testament.

Item One: - It is my wish that all of my just debts and funeral expenses be paid as soon after my death as possible.

Item Two: - All the residue of my estate, real, personal and mixed, I give, devise, and bequeath to my beloved wife, Maria Miller, to have, to hold and to use during her natural life, hereby giving and granting unto her, power and authority to sell any of said personal property, and to use the proceeds thereof for her support should she so desire or to re-invest the same in other personal property.

Item Three: - At the death of my said wife, all of my said personal estate then remaining unconsumed and undisposed of, after the payment of any just debts of my said wife and of her funeral expenses and expenses of her last sickness, which shall be paid therefrom, I desire to be converted into money and divided among my children, grand children and great grand children according to the Statutes of the State of Indiana, providing for the descent of personal property.

Item Four: - After the death of my said wife, I will and direct that my real estate be divided among my children and grand children, as follows, towit:

1st: I give and devise to my grandchildren, Sanford Burk and Flora Boswell, children of my deceased daughter, Harriett Burk and to the son of Clara Cox, deceased, who was also a daughter of said Harriett Burk, jointly, an undivided one-third of the Southwest quarter of the north east quarter of Section Seven (7), township Fourteen (14) North, of Range Five (5) West, in Putnam County, Indiana.

2nd: I give and devise to my grandchildren, Charles Wright, Alice Wright, now Alice Cully(?), Vernie Wright, Maud Wright, Ona Wright and Edward Wright, children of deceased daughter, Amanda E. Wright, the undivided one-third of said Southwest quarter of the northeast quarter of said Section Seven (7), Township Fourteen (14) North, of Range Five (5) West.

3rd: I give and devise to my grandchildren, Ella Alexander, Fanny Boswell, Amelia Lancaster, Noah Miller, Henry Miller, Elizabeth Miller and Lucinda Miller, children of my deceased son, Monroe J. Miller, and to Dora Walters, granddaughter of said Monroe Miller, the undivided one-third of said Southwest quarter of the northeast quarter of said Section (7), Township Fourteen (14), North, of Range Five (5) West, in Putnam County, Indiana.

4th: I give and devise to my son, Franklin A. Miller, Forty-eight (48) acres off the north end of the south half of the northwest fractional quarter of Section Seven (7), Township Fourteen (14), North, of Range Five (5) West, in Putnam County, Indiana.

5th: I give and devise to my daughter,Charlotte T. Lancaster, Fourteen (14) acres off of the south end of south half of northwest fractional quarter of Section Seven (7), and Forty-four (44) acres off of the north end of the Southwest quarter of said Section Seven (7), Township Fourteen (14) North, Range Five (5) West, being fifty-eight acres (58) acres, in Putnam County, Indiana.

6th: I give and devise to my son, John R. Miller, the north half of eighty (80) acres off of the South end of said southwest fractional quarter of Section Seven (7), Township Fourteen (14) North, Range Five (5) West, being Forty (40) acres in Putnam County, Indiana.

7th: I give and devise to my son, Daniel B. Miller, forty (40) acres off of the south end of the said southwest fractional quarter of said Section Seven (7) Township Fourteen (14), North of Range Five (5) West, Putnam County, Indiana.

8th: I give and devise to my son, Wade A. Miller, the southwest quarter of the southeast quarter and the south half of the east half of the southwest fractional quarter of Section Six (6), township fourteen (14) North, of Range Five (5) West, in Putnam County, Indiana, containing Seventy-one (71) acres more or less.

9th: I give and devise to my son, George M. Miller, the west half of the southeast quarter of said Section Seven (7), township Fourteen (14) North, of Range Five (5) West, Putnam County, Indiana, containing eighty (80), more or less.

10th: I give and devise to my daughter, Barbara S. Cricks, the southeast quarter of the southeast quarter of Section Twelve (12) township Fourteen (14) North, of Range Six (6) West, in Parke County, Indiana, containing forty (40) acres, more or less.

11th: I give and devise to my daughter, Emley E. Knauer, the northeast quarter of the southeast quarter of Section Twelve (12), township Fourteen (14) North, of Range Six (6) West, containing forty (40) acres, more or less, In Parke County, Indiana.

All of the above devised of real estate mentioned in this item to be subject to the life estate, in said real estate given to my wife, Maria Miller, in Item Two of this Will.

Item Five: - I hereby nominate and appoint my son, Daniel B. Miller, executor of this will, my last will and Testament. Don, this 3rd day of June 1901, at Greencastle, Indiana.

The foregoing instrument was signed, declared and acknowledged by Edward R. Miller, as and for his last Will and Testament in our presence and was subscribed by us as witnesses at his request in his presence and in the presence of each other at Greencastle, Indiana, this 3rd day of June 1901.

Before me, John W. Houck, Clerk of the Putnam Circuit Court, personally came Henry Bicknell, one of the subscribing witnesses to the foregoing last will and testament of Edward R. Miller, late of Putnam County, Indiana, deceased, and being duly sworn on his oath, says that he was present at the execution of said last will; that the same was duly executed; that at the time of the execution thereof; said testator was of full age to devise his property, of sound mind and memory and not under any co-ercion or restraint; that said testator request this affiant and Lemuel Johns and Silas A. Hays to sign said will as witnesses, thereto which he accordingly did in the presence of said testator and in the presence of each other as subscribing witnesses thereto.

State of Indiana, Putnam County, ss: I, John W. Houck, Clerk of the Putnam Circuit Court, do hereby certify that the above and foregoing last will and testament of Edward R. Miller, late of Putnam County, deceased, was this day admitted to probate and record and the proof thereof duly made by Henry Bicknell, one of the subscribing witnesses thereto, which said will, together with such proof have been duly recorded in Record of Wills No. 3, page 555, in this office.
