FLEMING WILSON BODLEY SR., 14 Nov 1844 - 15 May 1895 OBITUARY: DIED---In Angola, Indiana, May 15, 1895, Fleming Wilson Bodley, aged 50 years, 6 months and 1 day. Deceased was born near Plymouth, Richland county, Ohio. At the age of eighteen years he enlisted in Co. B, 88th Ohio Regiment, and served one year. After receiving his discharge he and his mother removed to Kendallville where he resided for a number of years employed as train baggage man on the Lake Shore. He then came to Angola and on September 15, 1874, was married to Olive C. Carkhuff, who with two children, Leona and Thomas W. survive to mourn the loss of a husband and father. For the past twenty years he had been actively engaged in business in Angola. In 1894 he was elected sheriff of Steuben county, but had not taken his office. In the death of Mr. Bodley this community has lost a citizen who was held in the highest esteem, and the Congregational church a member who was zealous for every good work. Funeral services were held Saturday, May 18th, conducted by Rev. J. T. Robert. SECOND LARGE ARTICLE: The death of Sheriff-elect Bodley has suggested the inquiry in the minds of many as to what provision the law has made for the filling of the sheriff's office at the expiration of the term of the present sheriff. Section 5563 statutes of 1881 provides that the board of county commissioners shall fill vacancies in county offices, and that such appointments made by them shall expire when a successor is elected and qualified, who shall be elected at the next general election proper to elect such officers. Construing this section of the statute the supreme court in the 106 Ind. 203, has decided that when the person elected to a county office dies before the term of his predecessor expires, a vacancy occurs at the end of the regular term of the incumbent which should be filled by the commissioners. The supreme court has also decided that the person so selected by the commissioners can only hold the office under such appointment until a successor is chosen at the general election, 49 Ind. 41. It follows then from this statute and these decisions that on the expiration of Mr. Legg's term of office, which occurs on the 10th day of next September, it will be the duty of the board of commissioners to select a competent person to fill the office of sheriff until one can be elected by the people at the general election in November 1896.
