         Last Will & Testament of Thomas Sankey Sr.

Know all men by these presents that I Thomas Sankey Sen of Vigo County in the State of Indiana being of sound and disposing mind memory and discretion and feeling sensible of the uncertain tenure of life make ordain publish and declare this my last Will & Testament

1st I desire that after payment of my funeral expenses all my personal estate of every kind and description including in action and money on hand or on deposit  be divided between my children and grandchildren as follows.  To the children of my deceased son Abraham Sankey one ninth part less three hundred dollars which I advanced to their father in his life time.  To George Sankey, John Sankey, Thomas Sankey, Franklin Sankey, Rebecca Thompson and Eliza Leeper each one ninth part of the whole and to each one eighth part of the said three hundred dollars and to the children of my deceased son Hiram Sankey one ninth of the whole and one eighth part of the said three hundred dollars and to the children of my deceased son William Sankey one ninth of the whole and one eighth part of the said three hundred dollars to be deducted from the children of my deceased son Abraham Sankey.

2nd   I bequeath unto my children Rebecca Thompson Eliza Leper  Thomas Sankey John Sankey George Sankey and Franklin Sankey all of my estate to be divided between them share and share alike.

3rd   I appoint my son George Sankey the executor of this my last will and testament and I desire my estate to be settled without going into the court having Probate Jurisdiction and to this end I authorize and request my said executor to collect all debts due me at the time of my death and to give proper receipts and acquittences therefor to draw out money on deposit in any bank and receipt for the same and on payment to surrender notes bonds certificates of deposits and other evidence of indebtedness and to sue for and collect debts from any person or corporation and in fact to fully settle my estate and distribute the proceeds

according to the provisions of this will without giving bond  
taking out letters of administration or in any wise accounting to the court of common pleas.
In testimony whereof I hereto set my hand and seal this 7th day of October 1858

Signed sealed and acknowledged by the testator to be his last will and testament in the presence of the undersigned who each of us signed the same as witnesses at the request of the testator in his presence and in presence of each other

Be it remembered that on the 3rd day of January 1859 personally appeared in open court in the court of common pleas of said county John P. Baird & Martin Church who being duly sworn depose and say that they are the subscribing witnesses to the foregoing will, that they witnesses said will at the request of the testator that they saw him sign the same which he did in their presence and that they signed their names as witnesses in the presence of the testator and in the presence of each other and that the testator at the time of executing said Will used sound mind and disproving memory and not under coertion or restraint.
